General Terms and Conditions

1. Scope and Provider
These General Terms and Conditions (GTC) apply to all contracts concluded between you and

A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding the contract, acts in the exercise of their trade, business or profession (§ 14 BGB).
Deviating, conflicting or supplementary general terms and conditions of the customer shall not become part of the contract unless we expressly agree to their validity.
2. Subject Matter of the Contract
The subject matter of the contract is the sale of historical and used picture postcards as well as comparable collector's items. These are used, sometimes over a hundred years old, individual items; signs of age and use that correspond to the described condition and the age of the goods are typical of collections and do not constitute a defect.
Insofar as picture postcards contain depictions or symbols with a contemporary historical reference (e.g. from the period of National Socialism), these are offered exclusively as documents of contemporary history for the purposes of civic education, the defence against unconstitutional endeavours, research, art and science as well as reporting on current events within the meaning of §§ 86 (4), 86a StGB. With the order, the customer warrants an exclusively legally compliant use.
3. Conclusion of the Contract
The presentation of the goods in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to submit an order (invitatio ad offerendum).
You submit a binding offer to conclude a purchase contract by placing the selected goods in the shopping cart, going through the ordering process and submitting the order by clicking the button labelled "order with obligation to pay" (or an equivalent term).
After receipt of your order, we will send you an automatic acknowledgement of receipt by e-mail, in which your order is listed again. This acknowledgement of receipt only documents that your order has been received by us and does not yet constitute an acceptance of the offer. The purchase contract is only concluded when we expressly declare acceptance of the order in a separate e-mail (order confirmation) or dispatch the ordered goods to you.
Before bindingly submitting the order, you can view your entries as well as the contents of the shopping cart at any time and correct them using the usual keyboard and mouse functions as well as the "Back" function of your browser (§ 312i (1) sentence 1 no. 1 BGB).
4. Contract Language and Storage of the Contract Text
Only the German language is available for the conclusion of the contract. We store the contract text and send you the order data as well as these GTC by e-mail. You can view and print out the GTC at any time on this page. In addition, provided you have created a customer account, you can view your past orders in your account.
5. Prices and Margin Scheme
All prices stated are final prices in euros. As a reseller of used goods, we apply the margin scheme pursuant to § 25a UStG to the picture postcards offered. A separate statement of value added tax therefore does not take place and is not legally permissible.
Shipping costs may be added to the prices of the goods. The shipping costs are calculated in the shopping cart or at checkout and are displayed separately before the order is bindingly submitted.
6. Payment and Due Date
Payment is possible using the following payment methods:
- PayPal: Payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg. The terms of use of PayPal apply additionally.
- Advance payment/bank transfer: You transfer the invoice amount to our account at Deutsche Bank (account holder:
). We will provide you with the complete bank details in the order confirmation.
The purchase price is due for payment upon conclusion of the contract. In the case of payment by advance payment, the invoice amount must be transferred to the specified account within seven days of receipt of the order confirmation; dispatch takes place after receipt of full payment.
7. Delivery, Delivery Time and Transfer of Risk
Delivery takes place within Germany and internationally via DHL or Deutsche Post to the delivery address specified by you. The shipping methods and delivery countries available for your order are displayed during the ordering process.
We dispatch the goods promptly, in the case of advance payment after receipt of full payment. On the day of dispatch you will generally receive a dispatch notification by e-mail.
If you are a consumer, the risk of accidental loss and accidental deterioration of the sold goods only passes to you upon their handover to you. Should the goods be damaged or lost during transport, please contact us; we will take care of a replacement delivery or the refund of the purchase price.
8. Retention of Title
The delivered goods remain our property until full payment has been made.
9. Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal for distance contracts. Please refer to our Withdrawal Policy for details on the requirements, the procedure and the consequences of withdrawal as well as the model withdrawal form. The withdrawal can be declared informally, e.g. by e-mail to .
10. Warranty (Liability for Defects)
The statutory provisions of §§ 434 ff. BGB apply to liability for defects; the limitation period for claims arising from defects is also governed by the statutory provisions. Your statutory warranty rights are not restricted by these GTC.
Since these are exclusively used individual items, the owed condition is determined by the respective item description and the photos depicted there. Age- and use-related characteristics that correspond to this description do not constitute a material defect.
11. Liability
We are liable without limitation for damage arising from injury to life, body or health that is based on a breach of duty by us, our legal representatives or vicarious agents, as well as for other damage based on an intentional or grossly negligent breach of duty by us, our legal representatives or vicarious agents. Likewise, we are liable without limitation under the provisions of the Product Liability Act as well as to the extent of a guarantee assumed by us.
In the case of a slightly negligent breach of a material contractual obligation (cardinal obligation), the fulfilment of which is essential for the proper performance of the contract in the first place and on whose compliance you may regularly rely, our liability is limited to the damage foreseeable at the time of conclusion of the contract and typical of the contract.
Otherwise, liability is excluded. A change in the burden of proof to your detriment is not associated with the above provisions.
12. Consumer Dispute Resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
13. Applicable Law and Place of Jurisdiction
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer and have your habitual residence in another state, this choice of law only applies insofar as you are not thereby deprived of the protection granted to you by the mandatory provisions of the law of the state of your habitual residence (Art. 6 (2) Rome I Regulation).
If you are a merchant, a legal person under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship is the Provider's place of business. The same applies if you do not have a general place of jurisdiction in Germany or the EU or if your domicile or habitual residence is not known at the time the action is brought. We remain entitled to bring an action at your general place of jurisdiction as well.
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall take the place of invalid provisions.
